01Agreement and eligibility

These Terms are an agreement between you and MindMarvelous LLC ("we", "us") covering the Roadbuds app and roadbuds.app. By creating an account you accept them. If you do not accept them, do not use Roadbuds.

You must be at least 13 years old to use Roadbuds. If you are under the age of majority where you live, you may only use Roadbuds with the involvement of a parent or guardian.

02Road safety

You agree that:

• You will not hold, look at, or operate your device while driving. Set the app up before you set off and put the phone down.
• You will obey all traffic laws, speed limits and local rules on device use at all times. Nothing in Roadbuds is an instruction or an incentive to do otherwise.
• You will not drive in any way you would not otherwise have driven in order to gain XP, unlock a car, extend a streak or encounter another user. Chasing, following, racing, impeding or photographing another driver from a moving vehicle is prohibited and is grounds for immediate termination.
• You are solely responsible for your driving. Roadbuds awards progress for passes that happen on journeys you were making anyway; it never asks you to make a journey.

If you are a passenger rather than the driver, the restrictions on interacting with the device do not apply to you, but every other rule here does.

03Your account

• Give accurate information when you register, and keep it accurate.
• You are responsible for what happens under your account and for keeping your password secret. Tell us promptly at hello@roadbuds.app if you think someone else has access.
• One account per person. Do not sell, rent or transfer your account.
• Do not register a vehicle you do not drive, and do not submit verification photos of a car that is not the one you are registering.

04Rules of conduct

You agree not to:

• Harass, threaten, stalk, impersonate or abuse another person, on or off the road.
• Use Roadbuds to locate, follow or approach another user who has not chosen to share their location with you.
• Falsify your location, spoof GPS, automate the app, or otherwise manufacture encounters or progress you did not earn by driving.
• Post or send anything unlawful, hateful, sexually explicit, violent, defamatory, or designed to harass.
• Share another person's private information, including a licence plate, home address or workplace.
• Scrape, reverse engineer, overload or attempt to gain unauthorised access to any part of the service.
• Use Roadbuds for any commercial purpose without our written permission.

05Content you post

You keep ownership of everything you submit — your photos, your profile text, your messages. By submitting it you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it for the sole purpose of operating and improving Roadbuds. That licence ends when you delete the content or your account, except where we must retain something to comply with the law or to enforce these Terms.

You are responsible for what you submit, and you confirm you have the right to submit it.

06Objectionable content and moderation

The following are prohibited without exception:

• Sexually explicit material, and any sexualised content involving minors.
• Content that harasses, bullies, threatens or incites violence against a person or group.
• Hate speech, or content attacking people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, age or sexual orientation.
• Content promoting self-harm, illegal drugs, or criminal activity.
• Content promoting dangerous driving, including street racing, stunt driving on public roads, or evading law enforcement.
• Another person's private information, including readable licence plates.
• Spam, scams, and impersonation.

How to report

Every profile, vehicle and conversation in Roadbuds carries a report control. You can also email us at hello@roadbuds.app. Reports can be made anonymously and the person you report is not told who reported them.

How we respond

• We review reports within 24 hours of receiving them.
• Content that breaches these Terms is removed, and the account that posted it is suspended or permanently terminated depending on severity.
• Anything involving a credible threat to someone's safety, or the sexual exploitation of a minor, is escalated immediately and reported to law enforcement.

Blocking

You can block any user at any time from their profile or from a conversation. Blocking is mutual and immediate: you disappear from each other's maps, lists and conversations, and neither of you can contact the other again.

07Vehicles, marks and photography

Roadbuds refers to vehicles by their real manufacturer and model names in order to identify them. All manufacturer names, model names and logos are the trademarks of their respective owners. Roadbuds is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer.

Reference images in the CarDex catalogue are used under the licences granted by their respective photographers. See Photo credits for the licences involved, what we are and are not able to attribute, and how to have a photograph credited or removed. If you believe an image is used improperly, contact us at hello@roadbuds.app and we will remove it while we investigate.

Photograph only your own vehicle. Do not photograph other people's vehicles, and never photograph anything from behind the wheel of a moving car.

08The game and your progress

XP, levels, medals, streaks and CarDex entries have no monetary value, cannot be exchanged for anything of value, and are not your property. We may adjust how progress is earned as the game is balanced, and we may reverse progress obtained by breaching section 4.

Roadbuds is under active development. Features may change or be removed, and we do not guarantee that the service will be uninterrupted or error-free.

09Suspension and termination

You may delete your account at any time from within the app. We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if your conduct puts another user at risk. Where the breach is serious — particularly anything under section 2 or section 6 — we may do so immediately and without notice.

10Disclaimers

Roadbuds is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that location detection is accurate or complete, and Roadbuds must never be used for navigation, for emergency purposes, or as a means of locating a person.

Roadbuds connects you with other people. We do not vet users, and we are not responsible for the conduct of any user, whether online or in person. Use your judgement, and meet strangers at your own risk.

11Limitation of liability

To the fullest extent permitted by law, MindMarvelous LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of Roadbuds.

To the fullest extent permitted by law, our total liability for any claim relating to Roadbuds is limited to the greater of the amount you paid us in the twelve months before the claim, or 50 US dollars.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12Changes, law and contact

We may update these Terms. If a change is material we will notify you in the app before it takes effect, and the effective date at the top will change. Continuing to use Roadbuds after that means you accept the updated Terms.

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of law rules.

If any provision of these Terms is found unenforceable, the rest remains in force.
